By a judgment of 30th April 2025 the French Supreme Court, the Cour de Cassation, ruled that a builder was required by law to produce a 10-year civil liability insurance at the opening of the project.

Although it has been a legal requirement for over 30 years, many builders believe that they are exempt from having to prove the underwriting of such insurance. This has been particularly the case in recent years concerning photovoltaic building works which have been defective.
