Planning consents for construction in France have a limited validity period, within which the work must start.
Under current provisions, the validity period is 3 years. However, this has now been extended by 2 years, giving a total validity period of 5 years.
The planning consents concerned by the change as are follows:
Déclaration préalable de travaux;
Permis de construire;
Permis d'aménager;
Permis de démolir.
An extension is given initially for 1 year, which may be extended by a further year.
The extension concerns those planning consents delivered between 28th May 2022 and 28th May 2024.
For those planning consents granted between 1st Jan 2021 and 27th May 2022 the validity period has been extended by 1 year.
To apply for an extension, an application must be made to the local council at least 2 months before the end of the initial period of validity, or before the end of the first extension.
An extension of the consent will only be granted if the planning rules have not changed to the detriment of the existing consent.
If the planning consent is extended, then a notice to that effect must be displayed on the development site.
